  1. INTRODUCTION

By signing the agreement you are agreeing to have been given a copy of this agreement and agree to abide by the rules of membership. You also acknowledge and agree that you are medically sound to undertake a normal course of exercise, you use the club facilities at your sole risk and responsibility and you are aware that exercise is physically demanding and participation in some activities may pose a risk to your health.

  1. OUR MISSION

Quany’s Gym aims to improve our members’ quality of life by providing facilities, services, and an environment that supports them in growing stronger. Quany’s is an oldschool gym that encourages hard work and proper training.

We also aim to build a reputation as having the strongest community of any gym in Brisbane, because of the culture that we create among our members. Our culture represents:

  • Supporting each other regardless of our individual goals and a respect for fellow members.
  • No judgement – we understand that we all come from different backgrounds and experience levels of training. By practicing this in combination with (1), we can create an environment where everyone feels comfortable and a part of the gym family.
  • Consideration of others – this means putting weights and equipment back where they belong, offering to share equipment with other members, and being aware of how much space you are using while training. This is about the overall harmony of the gym.
  1. DEFINITIONS

In this Agreement unless the contrary intention appears:

The singular includes the plural and vice versa.

A reference to a party includes that party’s legal personal representative heirs and assigns.

“Member” includes the parent or guardian of the Member if the Member is under 18 years.

”Quany’s” means Quany’s Pty Ltd named in the form of the agreement.

  1. RECEPTION AND ACCESS

All members must scan their 24/7 membership card (received upon joining) when entering the gym.  If entering the gym after hours the rear entrance will need to be utilised to gain access. Card scan during and outside of hours is compulsory for security and insurance requirements.  If you are a prospective member or a member who has not filled out the pre -exercise agreement form, then you must sign in on the casual register at your time of arrival as well as sign out upon exiting the premises.

Upon joining Quany’s a photo will be taken of you for security reasons relating to the safety of our members. The photograph will not be used for any other purposes and will be stored on our database.

  1. DRESS CODE

Fully enclosed, clean sports shoes must be worn during workouts for safety reasons. Members are required to wear a singlet or t-shirt at all times.

  1. TOWELS

Towels must be used when participating in classes and when exercising on gym equipment to maintain hygiene and safety standards. Where available you can hire a towel for $2.00 from reception.

  1. CHILDREN

Due to Quany’s Gym’s insurance policy, children under 16 years of age are not permitted to use Quany’s Gym facilities or equipment. The member indemnifies the Gym against any claim that may be made by the member or the member on behalf of a minor or administrator or executor of a member or any other person that may bring onto the premises of the Gym whether to use the facilities and services of the Gym or otherwise. All such persons use the Gym services and facilities in all respects at their own risk.

  1. USE OF EQUIPMENT

We ask that you return weights and bars to their racks when you have finished with them.

This includes unloading plates from machines and bars when you have finished your set. This rule also applies to equipment used in Group Fitness classes (steps, mats, pump bars, etc). It is important that you are aware of other members when using the equipment, as this contributes to the environment of the gym.

  1. LOCKERS

Open lockers/Pigeon holes are available and are located in front of the bathrooms and at reception. Please look after your personal items, Quany’s employees or contractors, are not responsible for any loss of personal property. Lockers/Pigeon holes provided are not security devices and are not lockable please keep all valuables with you while using the facilities.

  1. LOST PROPERTY

We highly recommend that you use lockers for your belongings. Quany’s does not take responsibility for loss or damage of your belongings. Any items of lost clothing will be held for two weeks, and then donated to charity.

  1. MEMBERSHIP ENTITLEMENTS
  • Membership at Quany’s entitles you to:
  • Workout 24 hours a day
  • Participate in normally scheduled Group Fitness classes.
  • Use of exercise equipment located on the gym floor and cardiovascular training areas.
  • A free initial body assessment (for further assessments please see reception for pricing).
  • Member Referral Incentives – the member will receive a free month for every member they refer to Quany’s Gym. The referred member must be a member for at least three (3) months for a free month to be allocated.

OBLIGATIONS

Membership at Quany’s requires you to:

  • Comply with all gym standards. It is important that we all work together in creating the environment that facilitates growing stronger.
  • Inform us in advance if there is any risk to your health if you participate in fitness services.
  • You acknowledge that it is your responsibility to cancel direct debit facilities with respect of your membership when this agreement expires or is terminated.

SPECIAL CONDITIONS REGARDING MEMBERSHIP ENTITLEMENTS

  • Quany’s reserves the right to make changes to exercise equipment supplied at any time. Quany’s also reserves the right to make changes to the Group Fitness timetable at any time. (ie. alter class type, times and instructors). We are committed to keeping you informed with any changes that may arise.
  • All entitlements and entry into any Quany’s is revoked if a member’s account is in arrears in excess of $50.00.

CHANGES TO CONDITIONS

Quany’s reserve the right to change the conditions contained in this agreement at any time.

  1. CANCELLATION / TERMINATION

The STEADY membership has a 48 hour cooling off period in which the member may terminate the agreement with no notice.

Outside of the cooling off period, you may give 30 days’ notice for cancellation of your membership. Members must provide written notice via email to

“info@quanysgym.com.au”. Verbal or any alternate form of notice will not be accepted. During this 30 day period, payments will continue as per normal, and your membership will remain active until the 30 day notice period expires.

Quany’s staff will contact Debit success and ensure payments will discontinue 30 days after the notice is received. Should the member wish to handle their cancelation themselves, they may cancel their membership directly with Debit Success. A free call is available to Debit Success to discuss such matters (1800 148 848)

By signing this agreement, you are agreeing to adhere our cancellation policy. Quany’s Gym is not required to provide refunds if this policy is not followed.

  1. GYM SAFETY

Members must be aware of the safety procedures at Quany’s Gym. This includes the following safety briefing:

  • Provided for your safety is a fully automated back to base security system with surveillance cameras, emergency buttons and Duress lanyards (located at rear entry door).
  • Once you enter the gym, if no one else is in- the lights, music and TV’s will automatically come on.
  • In an emergency situation or if you feel your safety is at risk you can press the DURESS EMERGENCY buttons at any time:
    • On your lanyard (*Lanyards are stored on the wall at the back door entry point)
    • At Rear of the Gym -Pull Tab
    • In Classroom- on wall
    • Centre of gym silver speaker box on wall next to classroom doors- this option enables you to speak to the control centre for help.

*Once pressed, the Control Centre will access the security cameras and decide on the correct course of action, calling on either Ambulance/ Police/ Fire services or in case of a non-emergency the Gym Owners are notified and a ‘security guard’ may be sent out to patrol.

ALARM/STROBE LIGHTS

If the sensors detect no movement for a significant time the alarm will activate and a voice will come over the sound system to alert you that the Gym is about to go into an ‘ARMED’ state as if the premises is  vacant. You are directed to go to the reception or back door and RE-SWIPE your key tag to prevent the Alarm from arming.

We hope that you enjoy the new extended hours and that if you have any concerns at all that you come and chat to our friendly staff.

By signing this agreement, you acknowledge that you have read through the above safety procedures, and been briefed by a member of staff on all necessary safety procedures.

  1. DAMAGE & PERSONAL INJURY

To the extent permitted by law, Quany’s excludes any liability to the Member in Agreement, tort, statute or in any other way for any injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by the Member and/or any other person, or for any costs, charges or expenses incurred by the Member, arising from or in connection with this Membership Agreement and/or the services/products provided by Quany’s and/or Debit Success, and/or any act or omission of Quany’s and/or Debit Success.

  1. SUSPENSION OF MEMBERSHIP PAYMENTS

Suspensions are available for free for up to 4 weeks per year. Any additional suspension period will incur a $5.00 weekly fee. Direct debit clients will have their suspension fees directly debited by Debit Success. Membership suspension fees do not contribute to the total membership.

Members must provide written notice via email to “info@quanysgym.com.au”. Verbal or any alternate form of notice will not be accepted.  If a member wishes to handle the suspension themselves a free call is available to Debit Success (1800 148 848)

Membership suspension cannot be used once the member gives 30 days’ notice for cancellation. Quany’s Gym is not required to provide refunds if this policy is not followed.

  1. PAYMENTS BY DIRECT DEBIT

If paying by Direct Debit the Member agrees to pay the instalment amount at the agreed payment frequency until this Agreement is terminated in accordance with Clause 12 above. Should there be any arrears in payments the Member authorizes Debit Success to debit the outstanding balance in order to bring the account up to date. It is the member’s responsibility to inform Debit Success of any changes to bank details etc. or if they wish to cancel their membership. Debit Success contact details are always displayed at reception.

Changing your billing information:

To change billing details, Members must provide written notice via email to “info@quanysgym.com.au”. Verbal or any alternate form of notice will not be accepted.

If a member wishes to handle the changes to billing information themselves a free call is available to Debit Success (1800 148 848).

By signing this agreement, you are agreeing to adhere our policy on changes in billing information. Quany’s Gym is not required to provide refunds if this policy is not followed.

  1. FEES (DIRECT DEBIT)

Direct Debit fees include a one off ‘establishment’ fee of $10, and a transaction fee of 5.21% for every payment processed. These fees are enforced by Debit Success, from which Quany’s receives no commission.

All members must pay $40 for their key tag which gives them 24/7 gym access. Key tag replacement cost is $40.00. Both the establishment fee and access tag fee are nonrefundable.

Please note, if you have insufficient funds in your account and a payment cannot be processed, a $10 fee for reversal of funds will be charged by Debit Success.

  1. NON-MEMBERS

Please do not bring non-members into the Gym during non-staffed hours. We have surveillance and when caught the penalties for members doing this are as follows:

  • 1st offence – Fine $150 + Suspension until paid and spoken with Quany’s Owner/Manager
  • 2nd offence – Immediate cancellation of membership and ban from Quany’s Gym. No refunds.

It is important for safety and insurance reasons that you abide by these rules.

  1. PRIVACY

A Customer’s “personal information” (as that term is defined in the Privacy Act 1988 (Cth)) will only be used by Quany’s or Debit Success to provide you with the services contemplated by this Agreement. Debit Success’ Privacy Statement is to be found on its website www.debitsuccess.com.  Quany’s Privacy Statement can be obtained its website www.quanysgym.com.au.

Quany’s Gym is required to use surveillance cameras to monitor the gym premises 24/7. All footage is held for a two year period as per Kudos Security Solutions policy.

By signing this agreement, you consent and agree that Quany’s Gym has the right to take or use photographs of me (and/or my property) and to use these in any and all media including online, now or hereafter known, for non-profit purposes. I hereby release to the Photographer all rights to exhibit this work in print and electronic form publicly or privately and to market copies.

  1. ENTIRE AGREEMENT

This Agreement, and the DDR Service Agreement (if paying by Direct Debit) constitute the entire agreement, understanding and arrangement (express and implied) between the Member, Quany’s and Debit Success relating to the subject matter of this Agreement and supersedes and cancels any previous agreement, understanding and arrangement relating thereto whether written or oral.

By submitting this form I declare that:

  • To the best of my knowledge and belief I am physically fit and there is no other medical condition or disability likely to cause any injury or health issue, before, during or after exercising at the facility.
  • I agree to the Quany’s Gym Agreement including the Terms and Conditions in full.
  • I declare that I am over 16 years old, I also agree to provide a guarantor form if under 18 years of age.
